The court acknowledges that Najib can still recall witnesses and permits the amendment of his three 1MDB charges
Three of the 25 counts that former prime minister Datuk Seri Najib Razak was facing in the 1Malaysia Development Berhad (1MDB) trial were modified by the prosecution today, according to the High Court.
Trial judge Datuk Collin Lawrence Sequerah stated that Najib's defence would not be jeopardised because the prosecution's storyline remained unaltered and that the only things that had changed were the quantities of 1MDB money mentioned in these three accusations.
Mala fide is the Latin word for bad faith, and the judge used it to describe the changes made to Najib's charges, saying they were "nothing sinister or mala fide."
The judge stated, "In any case, there is a safeguard in the Criminal Procedure Code that permits the defence to call witnesses, but only to address certain modifications, such as the amount changed in the charge.
Next, Najib—dressed in a blue suit and tie—was told the three modified charges.
